• Introduction

Welcome to hiArchy, LLC ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website and services. By accessing our website or using our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our website or services.

• Client: Licensed professionals in architecture, interior design, and residential design.
• Services: All services provided by hiArchy, LLC, including but not limited to design support, project management consultation, graphic design, 3D modeling, rendering, and photorealistic visualization.
• Website: The website is operated by hiArchy, LLC, and is located at https://hiarchy-llc.com/.

• Eligibility: You must be at least 18 years old to use our services. By using our services, you represent and warrant that you are at least 18 years old and are a licensed professional in architecture, interior design, and residential design within the jurisdiction of the project being designed.
• Account: Some features of our services may require you to create an account. You agree to provide accurate, current, and complete information when creating your account and to update your information as necessary.
• Prohibited Activities: You agree not to use our services for any unlawful purpose or in a manner that could damage, disable, overburden, or impair our website or services. Prohibited activities include, but are not limited to, unauthorized access to our systems, distributing malware, or using our services to violate any laws.

• Consultation and Deliverables: We will provide the services as agreed upon in the project scope and agreement with the client. All deliverables prepared in collaboration with hiArchy, LLC are required to be under the responsible control of a licensed or registered design professional, per NRS 623 or the statues of the jurisdiction of work being performed, and the licensed professional seals/stamps/signs the plans. 
• Payment: Fees for our services will be outlined in the agreement. Payment terms, including due dates and acceptable payment methods, will also be specified in the agreement. Late payments may incur additional charges.
• Cancellation and Termination: Either party may terminate the agreement with written notice if the other party breaches any material term of the agreement and fails to remedy the breach within 30 days of receiving notice. Upon termination, the client will pay for all services rendered up to the termination date.

• Ownership: All intellectual property rights in the deliverables created in collaboration with hiArchy, LLC as part of the services remain with the client. Any intellectual property displayed within this website is copyright protected and subject to revokable privileges granted to hiArchy, LLC.

• No Warranties: Our services are provided "as is" and "as available," without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Limitation of Liability: In no event shall hiArchy, LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use of our services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; and (iii) any interruption or cessation of transmission to or from our services.

You agree to indemnify, defend, and hold harmless hiArchy, LLC, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of our services or your violation of these Terms.

These Terms and any disputes arising out of or related to these Terms or our services will be governed by the laws of the State of Nevada, without regard to its conflict of law principles.

hiArchy, LLC is a specialized design consultancy collaborating exclusively with licensed professionals in architecture, interior design, and residential design. By providing advanced design and visualization services within the regulatory limits of NRS 623, hiArchy enhances its clients' projects through high-caliber 3D modeling, photorealistic rendering, and detailed design support.

hiArchy, LLC provides services tailored to exclusively support licensed architects, interior designers, and residential designers:

• Design Support: Assisting licensed architects, interior designers and residential designers with design development, detailing, and material selection.
• Project Management Consultation: Providing support in project scheduling, resource allocation, and quality control.
• Graphic Design: Creating branded project materials, presentations, and marketing assets to enhance client proposals.
• 3D Modeling & Rendering: Developing detailed models and realistic renderings to support visualizations of design concepts.
• Photorealistic Visualization: Producing high-quality, lifelike imagery that allows clients and stakeholders to see potential outcomes with accuracy.

All services adhere to NRS 623 limitations, ensuring no unlicensed practice of architecture.

Compliance with Nevada Revised Statutes (NRS) Chapter 623

hiArchy, LLC strictly follows NRS 623 by ensuring all services support but do not replace the roles of licensed professionals. Services are carefully designed to fall within allowable activities, with hiArchy enhancing client projects through supplementary design and visualization services exclusively with licensed professionals in architecture, interior design, and residential design. 

Any disputes arising out of or relating to these Terms or our services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in Las Vegas, Nevada, and the arbitrator’s decision will be enforceable in any court of competent jurisdiction.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of our services after the posting of changes constitutes your acceptance of such changes.
